दलमा आबद्ध शिक्षकलाई कारबाही गर्न शिक्षा मन्त्रालयको परिपत्र

कावासोती । शिक्षा, विज्ञान तथा प्रविधि मन्त्रालयले दलमा आबद्ध शिक्षकहरूलाई कारबाहीका लागि परिपत्र गरेको छ । शिक्षामन्त्री सुमना श्रेष्ठले दलमा आबद्ध शिक्षकलाई कारबाही गर्ने निर्णय गरेसँगै मन्त्रालयले कारबाहीका लागि शिक्षा तथा मानव स्रोत विकास केन्द्र (सीएचआरडी) लाई परिपत्र गरेको हो ।

मन्त्रालयले राजनीतिक दलको सदस्यता लिएका तथा दलमा आबद्ध भएका शिक्षकहरूको अनुमानित विवरण तयार पारेर केन्द्रलाई पठाएको हो । शिक्षा मन्त्रीको सचिवालयका अनुसार कानुनी व्यवस्थाअनुसार नै दलमा आबद्ध शिक्षकमाथि अनुसन्धान गर्न र आबद्धता पाइएमा कारबाही गर्न लेखि पठाएको हो ।

शिक्षा ऐन, २०२८ (संशोधनसहित) को दफा १६ (ङ) को उपदफा (५) को खण्ड (छ) मा ‘शिक्षक वा कर्मचारी राजनैतिक दलको कार्यकारिणी समितिको सदस्य रहेको पाइएमा पदबाट हटाइने’ व्यवस्था छ । त्यस्तै शिक्षा नियमावली, २०५९ (संशोधन सहित) को नियम १३८ को उपनियम (१) मा सेवाबाट हटाउने वा बर्खास्त गर्ने व्यवस्था छ ।

शिक्षा नियमावली, २०५९ (संशोधन सहित)को नियम १४३ को उपनियम (१) को खण्ड (घ) बमोजिम सेवाबाट हटाउने वा बर्खास्त गर्ने अधिकार प्रदेश सरकारको शिक्षा विषय हेर्ने मन्त्रालय मातहतमा रहेको प्रदेश शिक्षा विकास निर्देशनालयको निर्देशकलाई दिइएको छ ।

सोही कानुन प्रावधानमा रहेर दलका शिक्षकलाई कारबाहीको प्रक्रिया अगाडि बढेको हो । केन्द्रले मन्त्रालयबाट आएको विवरणका आधारमा अनुसन्धान गर्न शिक्षा विकास तथा समन्वय इकाइलाई परिपत्र गर्नेछ । र इकाइले अनुसन्धान गरेपछि दलमा आबद्धता देखिएको खण्डमा कारबाहीका लागि प्रदेश शिक्षा निर्देशनालयलाई परिपत्र गर्नेछ । र सोही आधारमा निर्देशनालयले दलमा आबद्ध शिक्षकहरूलाई सेवाबाट बर्खास्त गर्ने वा हटाउन सक्ने कानुनी व्यवस्था छ ।
